Mental Capacity Act 2005

mental capacity act 2005

There is information online and your social care worker will also go through the principles in more detail with you. The legislation states that a person aged 16+ years must be assumed to have capacity and we must not treat people as incapable of making a decision unless all practical steps to help them have been taken.

In line with the Mental Capacity Act, there are also options to apply to become someone’s Lasting Power of Attorney or Deputy if they cannot make a decision for themselves at the time it needs to be made.
